A son who allegedly killed his elderly mother in Melbourne is unlikely to run a mental impairment defence, a court has been told.
Thomas Bednar is charged with the murder of his 78-year-old mother Judy Bednar after she was found dead in her Chelsea home in May 2021.
The 53-year-old appeared virtually for a mention hearing in the Supreme Court of Victoria on Wednesday after pleading noxjmtzywt guilty to the crime.
His lawyer John Desmond said he did not anticipate they would run a mental impairment defence but sought expert opinions on the issue.
“My client has firm views on the matter,” the barrister said.
Prosecutors told the court there was still an outstanding DNA statement that would not be ready until the end of April.
A preliminary trial date was set down for November this year.
During an earlier court hearing late last year, Mr Bednar said he was innocent.
“It’s a set up and I am pleading not guilty. The case is very weak for the prosecution,” he said.
Mrs Bednar – a Holocaust survivor – was discovered dead in her home after concerned neighbours contacted police because the woman had not been seen in several days.
The elderly woman fled Hungary with her family after World War II and arrived in Melbourne as a teenager in 1956.
Mr Bednar is expected to return to court in June.
